Here's my suggestion: have it scale at a slower rate than a regular melee attack. The power attack already scales at half the rate of a two-handed attack. Have the Str scale at half the rate too. That is, after all this wall of text: don't double the Str modifier for the damage on a miss. At that point, since it is toned down a bit, I think it would also be ok to make it real damage, not just nonlethal. :That still wouldn't balance it, IMO. There's also the issue that, against foes that can take nonlethal damage, it basically turns all power attacks into touch attacks. Nonlethal damage is just as good at taking down a foe as lethal damage is.
