The creature affected by this spell takes 1d6 points of non-lethal damage any time they attack (that is, any action which would break invisibility). A creature can attempt to gain another saving throw against the effect by reaffirming their desire to attack as a full round action.
If cast from a higher spell slot, the spell DC is adjusted as if by Heighten Spell metamagic automatically, and the spell deals 1d6 points of damage per spell level. This effect does not stack with Heighten Spell metamagic. For example a 9th level spell deals 9d6 non-lethal damage per attack.
